1. Acceptance of Terms

By accessing and using the Capsule website (capsulewear.co) and all associated services, features, and content (collectively, the "Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. Capsule reserves the right to modify these Terms of Service at any time. Your continued use of the Service following the posting of revised Terms indicates your acceptance of such modifications.

2. Description of Service

Capsule operates an online platform designed to provide users with fashion, wardrobe management, and related informational content. The Service includes, but is not limited to, access to clothing recommendations, wardrobe planning tools, style guides, product information, and community features. Users can browse content, create accounts, and access subscription-based features. Capsule is committed to delivering quality content and services, though we make no guarantee that the Service will be uninterrupted or error-free.

3. User Accounts

To access certain features of the Service, you may be required to create a user account. When creating an account, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and password. You agree not to share your account with others or allow others to use your account. You are solely responsible for all activities that occur under your account, whether authorized by you or not.

Capsule reserves the right to suspend or terminate any account that violates these Terms of Service or engages in prohibited conduct. You must notify Capsule immediately of any unauthorized use of your account or any security breach.

4. Payment Terms

4.1 Subscription Fee

The Service is offered as a subscription at a monthly rate of $19 USD per month. Subscription fees are billed automatically on a recurring monthly basis. The subscription renews automatically unless canceled before the renewal date. You authorize Capsule to charge your designated payment method for the subscription fee on each renewal date. All prices are subject to applicable taxes, which will be added to your billing amount.

4.2 Billing and Payment

Capsule uses third-party payment processors to handle subscription billing. By providing payment information, you authorize Capsule and its payment processors to charge your account. Payment information is processed securely in compliance with industry standards. You are responsible for ensuring that your payment method information is current and valid.

4.3 Cancellation Policy

You may cancel your subscription at any time by accessing your account settings and selecting the cancellation option, or by contacting Capsule customer support. Cancellation requests must be submitted before the next billing date to avoid being charged for the following month. Upon cancellation, your access to premium features will continue until the end of your current billing period. No refunds will be issued for partial months or unused portions of your subscription.

4.4 Refund Policy

Capsule offers a limited refund policy as follows: If you request a refund within seven days of your initial purchase or subscription commencement, and you have not accessed substantial portions of the premium content or services, Capsule may issue a full refund at its sole discretion. Refunds requested after seven days from the subscription start date will not be honored, except in cases where Capsule has failed to provide the Service as described.

Recurring subscription charges are non-refundable except as provided above. If you cancel your subscription, you will not receive a refund for any fees already paid for the current billing period. Refunds, if approved, will be credited to your original payment method within ten to fifteen business days.

Promotional offers, discount codes, and special offers are non-refundable and non-transferable. If you received a discount or promotional rate, the refund will be calculated based on the discounted amount you paid.

4.5 Price Changes

Capsule reserves the right to change subscription pricing with thirty days advance notice. Price increases will not apply to existing subscribers during their current billing period. If you do not agree to a price increase, you may cancel your subscription before the new price takes effect.

5. Intellectual Property Rights

All content, materials, designs, text, graphics, images, videos, audio, logos, and other elements displayed on the Service, including but not limited to the Capsule branding, website design, and original articles, are the exclusive property of Capsule or its content providers and are protected by international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial purposes only. You may not reproduce, modify, distribute, transmit, display, perform, or otherwise use any content from the Service without Capsule's prior written consent, except as necessary to view the content on your device as part of normal use.

Any user-generated content, including comments, reviews, and submissions, may be used by Capsule in accordance with our Privacy Policy. By submitting content to the Service, you grant Capsule a perpetual, royalty-free, worldwide license to use, reproduce, modify, and display your content.

All trademarks, service marks, and trade names used on the Service are the property of their respective owners. Unauthorized use of any such marks is strictly prohibited.

6. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, CAPSULE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, EVEN IF CAPSULE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

CAPSULE'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATING TO THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT YOU HAVE PAID TO CAPSULE IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR FIFTY DOLLARS, WHICHEVER IS GREATER.

Some jurisdictions do not allow the limitation of liability for certain damages, so the above limitation may not apply to you. In such cases, Capsule's liability shall be limited to the maximum extent permitted by law.

CAPSULE DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS. CAPSULE DOES NOT WARRANT THAT DEFECTS WILL BE CORRECTED OR THAT THE SERVICE WILL MEET YOUR EXPECTATIONS OR REQUIREMENTS.

All content provided through the Service, including but not limited to fashion recommendations, wardrobe advice, styling tips, trend reports, and product information, is provided solely for entertainment and informational purposes.
